Morris, “it’s a challenge for everybody.”
Even if you find some land to develop, if it’s
not in an area where the state is actively encouraging growth, “the state might not co-operate with sewer extension permits,
roadwork and other infrastructure that’s
necessary,” according
to Brunelli.

major issue is our state’s arcane liquor license rules and regulations. Town centers in
other parts of the country usually have five
or six restaurants with licenses, but New Jersey doesn’t allow liquor licenses to be created for a low cost. In some towns, the cost
of a license is close to $1 million.”
Even if the state is on board with the development, municipalities or local property
owners can get in the way. “A client-owned
property in Hamilton Twp. was zoned for a
shopping center,” Harding relates. “We filed
an application that was compliant with the
zoning ordinance, but we were rejected and
appealed that to a superior court judge, who
granted our approval. That was appealed by
the municipality and ultimately it ended up
going to the New Jersey Supreme Court.”
The township ultimately lost, Harding recalls, but the two years it took to win the
case and recent squabbles over eminent domain have made others wary.
“Any developer in New Jersey could tell
you about a case where a city initially had
good intentions and declared an area in
need of redevelopment and then learned
that the developers were not stepping up or
were backing out because of recent court decisions,” says Brunelli.
But for now, there’s no denying that New
Jersey’s demographics are highly desirable for
developers and retailers. And the state, despite its reputation, has shown some willingness to help those who will help the state.—RENJ
